Apple obtine o hotarare de blocare a vanzarilor Samsung Galaxy S si Samsung Galaxy S II in UE

     Desi foarte multa lume nu s-ar fi asteptat la asa ceva, astazi Apple a reusit sa obtina un ordin de interdictie a comercializarii smartphone-urilor din seria Galaxy in Europa. Initial compania din Cupertino obtinuse o interdictie impotriva Galaxy Tab 10.1 de la o instanta din Germania insa acum avem o decizie a unei curti olandeze care interzice vanzarile smartphone-urilor din seria Galaxy in toata UE. Decizia vine in urma unei cereri introduse de catre Apple acum cateva saptamani la o instanta olandeza si se pare ca vorbim despre o victorie importanta pentru compania din Cupertino.

The Rechtbank ‘s-Gravenhage (a Dutch court in the city of The Hague) today issued an EU-wide preliminary injunction against Samsung’s Galaxy smartphones — but not the Galaxy tablets — at Apple’s request. The decision follows a hearing held on August 10 and 11, 2011.

    Decizia curtii olandeze va avea efect abia ppe data de 13 octombrie deci intre timp compania Samsung va putea comercializa linistita orice produse doreste in UE iar pana la acea data decizia ar putea fi chiar anulata daca Samsung reuseste sa demonstreze ca nu a incalcat vreun brevet de inventie. Decizia de astazi interzice vanzarea terminalelor Samsung Galaxy S, Galaxy S II si Ace insa nu si a tabletei Samsung Galaxy Tab 10.1 pentru care exista deja o alta decizie aflata in curs de solutionare la o instanta din Germania.

     O alta problema sta in competenta curtii olandeze de a interzice vanzarile in UE, mai exact decizia ei se aplica doar pentru tarile in care brevetul de inventie pus in discutie de catre Apple este considerat valid. Practic nu toate tarile din UE vor fi obligate sa o respecte iar decizia nu se aplica pentru compania “mama” Samsung ci pentru 3 companii subsidiare folosite pentru distribuirea produselor in Europa. Aceste 3 companii nu mai pot comercializa sau livra produsele catre partenerii Samsung insa compania in sine poate face acest lucru deci practic nu va fi oprit nimic in aceasta situatie.

  • This relates to countries in which one particular European software patent (EP 2059868) is valid. (Formally it’s a “device” patent, but it doesn’t represent any innovation on the hardware side, so the nature of the invention is that of a software patent the way I define that term.) The status of that patent varies between various countries as this list shows.

  • In legal terms, the order does not bind Samsung’s Korean parent company — only three different Samsung subsidiaries registered in the Netherlands — with respect to other countries than the Netherlands. However, it is my understanding that Samsung’s European logistics use the Netherlands as the primary hub. If Samsung’s Korean parent company wants to exercise its freedom to ship into other European countries despite this injunction, it will have to reorganize its logistics chain in Europe accordingly.

  •       Decizia curtii o gasiti aici insa cred ca nu se va ajunge vreodata la blocarea vanzarilor sau a livrarilor pentru ca in 7 saptamani Samsung are destul timp sa depuna o contestatie.
