In cursul zilei de ieri am scris un articol in care va spuneam ca o companie taiwaneza a reusit sa convinga o instanta din China sa nu accepte un proces intentat de catre Apple cu privire la marca inregistrata iPad. Compania taiwaneza Proview a inregistrat iPad ca marca acum mai bine de un deceniu insa Apple sustine ca si ea are denumirea inregistrata in alte tari si doreste sa obtina inregistrarea din China. Avand in vedere ca o instanta a decis deja ca in China Proview are inregistrata marca iPad, compania a decis sa dea in judecata Apple cerand interzicerea vanzarii tabletei in doua orase. Proview ceruse initial 1.5 miliarde de dolari de la Apple drept compensatii pentru vanzarea iPad in China insa presupun ca Apple a refuzat sa dea bani din moment ce s-a ajuns la un proces pentru interzicearea vanzarilor.
“Apple is such a Goliath and has a good image, so people wouldn’t imagine that Apple could possibly infringe on our intellectual property rights,” said Xiao Caiyuan, a lawyer for Proview at Guangdong Guanghe law firm. “People always think it’s small companies infringing upon large companies’ IPR.”
“We hope that this decision will make our negotiations with Apple a bit easier,” said Li Su, a representative of Proview. The Shenzhen Futian District Court is due to start hearing one case on December 30, and the Huizhou Intermediate People’s Court has scheduled a hearing in the other for January 7.We are starting with these two cities, and if we are successful in getting iPad sales stopped, we will consider going after Apple resellers elsewhere in China.

Interesant este ca Apple a cumparat in 2006 de la compania Proview dreptul de a folosi la nivel global marca iPad si acum compania sustine ca in China Apple nu ar avea dreptul sa faca acest lucru. Piata chineza reprezinta aproximativ 30% din totalul vanzarilor inregistrate de Apple in ultimele 3 luni iar o interdictie de vanzare a tabletei iPad acolo ar afecta serios profitul.
