Astazi o instanta din Olanda a decis sa respinga un apel intentat de catre compania Apple impotriva unei decizii date de o alta instanta din aceeasi tara. Apelul ataca decizia prin care companiei Apple i-au fost respinse pretentiile de interzicere a vanzarii Samsung Galaxy Tab 10.1 in Olanda din cauza incalcarii unor brevete de inventie ce aveau legatura cu design-ul tabletei. Se pare ca decizia curtii a avut la baza descoperirea a doua elemente de design care desi sunt inregistrate de catre compania Apple se regasesc in dispozitive prezentate cu multi ani in urma.

HP Compaq’s tc1000 si conceptul pentru tableta Knight Rider(pe care o aveti prezentata in clipul video de mai jos) au fost luate in considerare de catre instanta olandeza si in baza lor apelul celor de la Apple a fost respins deoarece elementele estetice pe care Samsung a fost acuzata ca le-a copiat nu erau tocmai unice. Chiar daca a pierdut apelul, nu toate elementele de design pe care Apple le poate invoca au fost prezentate in instanta deci exista sansa ca noi procese sa fie intentate. Practic instanta olandeza a decis ca design-ul iPad 2 a fost intalnit in trecut la alte dispozitive si Apple nu il poate apara acum.
