Astazi o inalta curte regionala din Karlsruhe, Germania, a decis ca Motorola nu poate folosi brevete FRAND pentru a impune interdictii impotriva companiei Apple atat timp cat o hotarare data in cadrul unuia dintre procesele celor doua companii a fost atacata prin apel. Decizia instantei germane poate fi desigur atacata prin apel insa deocamdata ea ii ofera companiei Apple o metoda prin care se poate proteja impotriva eventualelor abuzuri ale celor de la Motorola. Decizia curtii se bazeaza pe o oferta, a companiei Apple, de licentiere a tehnologiilor FRAND detinute de Motorola, oferta considerata a fi corecta de catre instanta Germana.
The Karlsruhe Higher Regional Court (“Oberlandesgericht Karlsruhe”), the appeals court within whose circuit the Mannheim Regional Court is based, decided today that Motorola Mobility is barred from further enforcement of its standard-essential patent injunction against Apple in Germany at least for the duration of the ongoing appeal. The appeals court summarily held that Apple has made an amended proposal for taking a license to MMI’s patents on FRAND terms that should be acceptable to MMI, turning any further attempts to ban Apple’s iPhone and iPad products into a violation of applicable antitrust law.
Desi vorbim despre o hotarare data doar in cazul unui apel, compania Apple se poate folosi de ea pentru a se proteja si in celelalte procese intentate de catre cei de la Motorola. Practic Apple a facut primii pasi spre incheierea unei intelegeri cu cei de la Motorola si instantele din Germania considera ca ea este cat se poate de corecta insa ramane de vazut daca oficialii celor de la Motorola/Google vor fi de aceeasi parere.
