Astazi o instanta din Olanda a luat o decizie intr-un proces in care erau implicate companiile Apple si Samsung iar compania coreeana a iesit din pacate invinsa din disputa. Samsung ii acuzase pe cei de la Apple ca incalcasera anumite brevete de inventie pentru tehnologii privind telecomunicatiile prin 3G atunci cand au conceput terminalul iPhone 4S insa instanta din Olanda nu a fost de acord cu aceste pretentii. De ce a pierdut din nou Samsung? Ei bine pentru ca a folosit brevete FRAND pentru a isi sustine cauza si pentru ca acele brevete FRAND erau deja licentiate companiei Qualcomm ale caror chip-uri baseband sunt utilizate in terminalul iPhone 4S.
In light of its FRAND licensing obligation governing patents allegedly essential to 3G/UMTS, Samsung cannot pursue injunctive relief as long as Apple appears willing to negotiate a license agreement on FRAND terms, an effort that shouldn’t be marred by the threat of an injunction. Furthermore, the court held that Samsung cannot assert 3G/UMTS patents against the iPhone 4S due to patent exhaustion: Apple is licensed by extension since it purchases baseband chips from Qualcomm, and Samsung’s attempt to terminate its license agreement with Qualcomm as far as third-party beneficiary Apple is concerned failed because Samsung had make a commitment to ETSI, the standards body in charge of 3G, that it would grant irrevocable licenses to its 3G/UMTS-essential patents.
Practic Samsung a fost de acord sa licentieze tehnologiile catre Qualcomm si si-a pierdut dreptul de a cere licentierea tehnologiilor de catre companiile care cumpara produse ale Qualcomm. Samsung a incercat de nenumarate ori sa blocheze vanzarile de iDevice-uri folosind tehnologii FRAND si cred ca strategia coreenilor este gresita cu intentie altfel nu-mi pot imagina de ce mizeaza pe ea de fiecare data din moment ce pana acum nu au reusit sa castige vreo hotarare in vreo instanta de pe glob.
