China este fara discutie una dintre cele mai interesante piete de desfacere ale companiei Apple deoarece acolo sunt generati extrem de multi bani, dar tot acolo iau nastere 90% dintre clonele iDevice-urilor. Deocamdata compania se concentreaza pe facut bani si mai putin pe descoperit producatorii clonelor, insa guvernul chinez are o problema cu modul in care Apple intelege sa ofere garantie pentru propriile produse. Pentru inceput compania Apple le cere chinezilor sa fie de acord ca iPhone-urile lor sa fie reparate folosind piese reparate sau noi, iar piesele preluate din terminalele lor sa fie trimise inapoi la Apple unde compania le poate repara si revinde catre alti clienti. Guvernul chinez spune ca Apple incalca legislatia nationala privind repararea produselor aflate in garantie deoarece in ea se prevede ca produsele trebuie reparate folosind componente noi.
One of Apple’s repair clauses requires customers allow Apple to use either new or retreaded spare parts in repair, and the replaced spare parts are returned to Apple. That means the company is taking a piece of defected equipment already paid by the customer and reselling those parts after they are repaired to other customers. O a doua problema are legatura cu modul in care Apple ofera garantie in cazul transportului iDevice-urilor, compania refuzand sa acopere pagubele produse terminalelor in timp ce acestea sunt transportate de la companie catre client si viceversa. Singurele pagube suportate de catre Apple sunt cele care apar in timpul repararii dispozitivului si desigur cele acoperite de garantia normala. La final ramane o clauza foarte ciudata care nu are vreo baza legala, mai exact Apple cere 1.57$ pe zi daca un terminal a fost in service-ul sau mai mult de 30 de zile de la data la care utilizatorul a fost chemat sa il ridice si daca 90 de zile trec de la acea data, compania considera ca dispozitivul a fost abandonat de catre utilizator. N-as putea spune ce baza legala are Apple pentru ultima parte a prevederii, insa nici guvernul chinez nu prea stie, asa ca Apple trebuie sa isi schimbe prevederile din contacte.
Apple has also been accused of exempting itself from responsibility for damage suffered by its products during transportation. Apple only compensates repair fees if a product is damaged while being repaired; damage caused during transport is not repaired free of charge. This clause is incompatible with the Contract Law and China’s Consumer Rights Protection Law, as it infringes on consumers’ right to demand compensation. In another clause, Apple says owners failing to collect their devices within 30 days after repair need to pay a so-called safe keeping fees (US$1.57 for each day) to reclaim them, and if more than 90 days it will be deemed to have abandoned ownership of the products. The statement said this clause lacks a legal basis and amounts to illegally usurping property rights.
In Romania din cate stiu eu nu exista prevederi la fel de ciudate in cazul repararii iDevice-urilor si daca ar fi fost, atunci sigur ar fi existat destule scandaluri in baza lor.
