In cursul serii trecute cei de la Reuters au anuntat ca Apple a castigat o batalie importanta in razboiul legal impotriva celor de la Samsung deoarece un judecator din SUA le-a oferit dreptul de a impune o interdictie preliminara de vanzare impotriva Samsung Galaxy Tab 10.1. Aceasta interdictie presupune blocarea vanzarilor Samsung Galaxy Tab 10.1 pe intreg teritoriul SUA si ea poate fi impunsa numai dupa ce Apple plateste o cautiune de 2.6 milioane de dolari care “protejeaza” Samsung in situatia in care decizia de astazi va fi anulata de un alt judecator.
Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products. While Samsung will certainly suffer lost sales from the issuance of an injunction, the hardship to Apple of having to directly compete with Samsung’s infringing products outweighs Samsung’s harm in light of the previous findings by the Court.
It’s no coincidence that Samsung’s latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong and, as we’ve said many times before, we need to protect Apple’s intellectual property when companies steal our ideas.
Decizia de oferire a interdictiei vine in urma unei cereri introduse de catre Apple in urma cu cateva luni cand compania din Cupertino a afirmat ca Samsung Galaxy Tab 10.1 ii incalca brevete de inventie cu privre la design-ul si interfata iDevice-urilor. Apple a castigat o interdictie asemanatoare in Germania, iar acolo cei de la Samsung au fost nevoiti sa refaca design-ul Galaxy Tab-ului pentru a repune tableta in vanzare. Desigur ca vorbim in SUA despre interzicerea comercializarii Galaxy Tab 10.1 modelul 1, deoarece modelul al doilea al tabletei inca nu a fost atacat de catre Apple.
Victoria celor de la Apple este extrem de importanta deoarece vine intr-o piata foarte mare, vine in tara natala si exista sanse ca ea sa nu fie singura impotriva Samsung.
UPDATE: Samsung facut deja apel impotriva deciziei instanatei americane, deci Apple nu poate impune deocamdata interdictia.
