Duminica trecuta aflam ca Apple si HTC au incheiat un acord global de licentiere reciproca a unor tehnologii, iar acest anunt a uimit foarte multa lume. Printre companiile uimite de anunt este si Samsung care a cerut unei instante americane sa dezvaluie detaliile acordului dintre cele doua companii. Avocatul companiei Samsung spune ca Apple ar fi licentiat catre HTC o serie de brevete pe care nu a dorit sa le licentieze coreenilor, printre ele aflandu-se cateva brevete ce acopera tehnologii importante ale iOS, un expert Apple afirmand ca acele brevete sunt “de neatins” si nu pot fi licentiate vreunei companii.
“As you know, the issue of Apple’s willingness to license its patents was briefed in Samsung’s opposition to Apple’s motion for permanent injunction,” wrote Quinn Emanuel’s Robert Becher, who is representing Samsung in the case. “This license has direct bearing on the question of irreparable harm and whether monetary remedies are adequate.” Becher added that the license could also shed light on whether Apple included some of its “unique” user experience patents, which it doesn’t share with other companies. In a testimony about that collection, Apple patent licensing director Boris Teksler referred to that collection as “untouchables,” that it only shared with a very small handful of other companies.
Interesul celor de la Samsung este cat se poate de normal, insa daca Apple nu a licentiat brevete FRAND, atunci nu o poate obliga nimeni sa isi licentieze tehnologiile catre Samsung. Apple are dreptul sa nu licentieze in vreu fel sau sa nu licentieze la pret mic anumite tehnologii ale sale, iar cei de la Samsung incearca sa convinga o instanta sa oblige Apple sa faca acest lucru. In subsidiar exista probabil si interesul de a afla ce sume sunt implicate in acordul cu HTC, insa probabil instanta nu va obliga Apple sa dezvaluie aceste detalii.
