Acum cateva saptamani de zile compania Apple a castigat un proces intentat Samsung in SUA, un juriu luand decizia de ca anumite produse ale coreenilor incalca brevete de inventie ale celor din Cupertino. In baza acestei victorii, compania Apple a depus in cursul zilei de ieri o motiune prin care cere instantei americane sa interzica vanzarea in SUA a terminalelor Samsung pentru care s-a decis faptul ca se incalca brevetele de inventie.
Surprise. Not. In a follow-up to this month’s $119 million jury verdict in the Northern District of California, Apple filed a motion for a U.S. permanent injunction against Samsung late on Friday by local time. With respect to the three patents Samsung has been held to have infringed (one of them by summary judgment and two by the jury), Apple is asking Judge Lucy Koh to order a U.S. sales ban.
Cererea companiei Apple are in vedere implementarile software ale codurilor protejate prin brevetele sale de inventie si se rezuma doar la dispozitivele in baza caruia a castigat respectivul proces. In baza acestei cereri, Samsung ar putea sa modifice Android OS-ul pentru a inlocui functiile incalcate cu alte implementari software ce nu incalca in vreun fel vreun brevet al Apple, asa ca produsele ar putea ramane pe piata.
The proposed injunction order would refer to the products at issue in the recent trial but would relate to any “software or code capable of implementing any Infringing Feature, and/or any feature not more than colorably different therefrom”, including software or code found in newer (even future) devices.
